Payday lending and triple digit interest rates have nothing to do with the Obama administration. Online lenders need to respect state laws… There are 37 states where it is legal so if NY is out what’s the big deal. Tribal Sovereignty needs to be looked at when people are being totally ripped off and when they don’t pay their lives become a living hell. It’s Karma … It’s all coming back to those who dished it out. Good Luck!

The damage is done. Tribe jobs in call centers and tribal lenders have already taken a “hit.” Tribal “virtual” business enterprises will certainly survive but tribe social and educational programs are suffering with layoffs and more in the short-term.

Yes, I think even AMG and Tucker would agree, a sophistication by all parties to the small dollar/payday loan/installment lending space has arrived. Continued demand by consumers world-wide will continue to drive innovation, technology and creative models for meeting this demand.

The tribe payday loan model, if for no other reason than to arbitrage the risk in employing an offshore, state-by-state, or choice-of-law lending model, makes a great deal of sense. Of course, your ultimate exit strategy, risk tolerance, etc. play a role in a lender’s ultimate course of action. And, if you have the ability to “run” simultaneous portfolios, the tribe model is a “no-brainer.”

AFS providers welcome all competition. Payday loan products will eventually be a “commodity.” Rates/fees borrowers pay will decline and only the lenders who provide outstanding customer service will survive.
